Nourishing Nature Terms and Conditions

Terms and Conditions for Nourishing Nature Experience 

Parties and application 

The parties to this agreement are: 

You (“the guest”, “you” or “your”). 

Volskov Limited, trading as the tour provider (“the tour provider”, “the provider”). 

The Hotel Britomart, trading as The Hotel Britomart Limited (“the tour facilitator”, “facilitator”, “hotel”, “We”). 

By completing the booking form and accepting the following booking conditions, you are agreeing to these conditions on behalf of yourself and all other persons named on the booking and represent that you are authorised to accept these conditions on their behalf. Everyone named on the booking, or if only one person is named, is hereafter referred to as “you”. 

 

  1. Booking and Payment

1.1.  Deposit: No deposit is required at the time of booking; however, credit card details must be provided at the time of booking to guarantee the booking. The booking will remain tentative, and no payment will be deducted from the credit card provided until the booking is confirmed 48 hours prior to departure, dependent on meeting the required numbers.  

1.2. Payment: Payment must be made via credit card including; VISA, Mastercard, American Express, Diners, China Union Pay, WeChat pay. A 2% credit card fee is applicable. 

1.3. Booking Confirmation: The booking will be confirmed 48 hours prior to the tour departure time, provided the minimum numbers required by the tour provider are met. Upon confirmation of the tour, full payment will be charged to the supplied credit card. Your reservation will only be confirmed once full payment has been processed.  

1.4. Once full payment has been processed, a confirmation email with booking details will be sent from the tour facilitator to your provided email address. 

 

  1. Cancellation and Refund Policy

2.1. The Tour Operator and the Tour Facilitator will endeavour to accommodate any alteration requests, however the ability to accommodate such requests may be limited due to availability and operational requirements.  

2.2. Cancellations made 48 hours or more prior to the tour departure time will receive a full refund.  

2.3. Cancellations made within 48 hours of the experience date will not be eligible for a refund. 

2.4. In the event of a no-show, no refund will be issued. 

2.5. The tour provider reserves the right to cancel the experience due to unforeseen circumstances, including but not limited to, adverse weather conditions or safety concerns. In such cases, a full refund or rescheduling option will be offered. 

2.6. If you are unable for any reason to start your tour this will be considered a cancellation by you and you will not be eligible for a refund as per clause 2.3. 

2.7. No refunds will be provided in the event of voluntary or involuntary early departure from a tour, or for missed or unused services including, but not limited to, transportation, activities and food. 

 

  1. Cancellations by the Tour Operator and/or the Tour Facilitator

3.1. Very rarely the Tour Provider and/or the Tour facilitator may need to cancel a scheduled tour. If cancellation is to occur more than 48 hours prior to the tour departure, you will have the choice of taking an alternative scheduled tour.  

3.2. The Tour Provider and/or the Tour Facilitator  are not responsible for any incidental expenses that you may have incurred as a result of the cancellation of your Tour booking, including but not limited to: visas, vaccinations, travel insurance excess or non-refundable flights. The guest is strongly encouraged to ensure travel insurance cover is taken. 

3.3. In the unlikely event that the Tour Provider and/or the Tour Facilitator is unable to complete the tour, alternative arrangements will be made for you at no extra charge. Or, if this is impossible, we will provide you with transport back to your point of tour departure and provide a refund for the cost of your tour. 

 

  1. Cancellation by Force Majeure

4.1 Force majeure is unusual and unforeseeable circumstances beyond the Tour Facilitator and/or the Tour Providers control, examples of which are: war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, floods or other similar events beyond our control. 

4.2 If the Tour Facilitator and/or the Tour Facilitator needs to cancel your scheduled tour before the date of departure due to Force Majeure, you will be entitled to transfer to a future tour, or a refund will be processed to the same credit card as payment was received.   

 

  1. Special requests

5.1. If you have special requests, such as dietary needs, you should inform the Tour Facilitator of such requests as soon as possible and not less than 48 hours prior to your tour departure time. The Tour Facilitator will advise any relevant parties of your requirements, but cannot guarantee that such requests will be met. Furthermore, the Tour Provider and the Tour Facilitator has no liability to you if such requests are not met. Failure to satisfy a special request is not be a breach of contract and no refund will be provided.  

 

  1. Change of departure date or Tour

6.1. To change your tour departure date or time, you must make your request to the Tour Facilitator in writing or by phone prior to the 48-hour confirmation period. Provided the requested date and departure time can be met by the Tour Provider, your reservation will be amended. 

6.2 If you do not have a new preferred date, or there is no availability on your preferred departure, the Tour Facilitator will cancel your booking and no refund will be provided. 

 

  1. Change of participants

7.1 If you or someone in your travelling party can no longer participate, you may transfer any paid and confirmed reservations to another person, not already in your travelling party, subject to them agreeing to be bound by the booking terms and conditions in effect at the time of the change. 

 

  1. Participation Requirements

8.1. Participants must be at least 18 years old to attend without adult supervision. Participants under the age of 18 must be accompanied by a responsible adult.  Due to the outdoor nature of this tour, participants under the age of 12 will not be able to attend the tour.  There is no concession to rates for participants under the age of 18. 

8.2. Participants should disclose any medical conditions or special needs at the time of booking to ensure appropriate accommodations can be made where possible. 

 

  1. Travel delays/missed departure

9.1 For the start of your tour to run smoothly, you will need to meet at the tour departure location – The Hotel Britomart Lobby at 29 Galway Street Britomart Auckland 1010 New Zealand, 15-minutes prior to the scheduled tour departure time. It is not possible to delay a tour departure time. If you miss the scheduled departure of your tour due to flight or other delays, the Tour Facilitator will endeavour to assist with travel arrangements so you can meet up with the tour at the earliest practical time, but these additional travel arrangements will be at your own cost. It is recommended to ensure your travel insurance covers such delays. 

 

  1. Travel documents

It is your sole responsibility to make sure that you have all necessary travel documents (e.g. passports, visas, transit visas, etc), and meet any government health requirements for your entire journey. Any information or advice given by the Tour Facilitator and/or the Tour Provider on visas, vaccinations, climate, clothing, equipment, baggage, etc. is given in good faith. The Tour Provider and Tour Facilitator are not liable for any disruption to your travel plans or any associated costs incurred because of your failing to have the correct travel documents. 

 

  1. Travel Insurance

We strongly encourage you to ensure you are covered by comprehensive travel insurance. This insurance should cover personal accident, medical expenses, and repatriation costs, loss of effects and all other expenses which might arise because of loss, damage, injury, delay, cancellation or inconvenience, or the inability to join your tour for any reason. You agree it is your sole responsibility to ensure your travel insurance cover is adequate for your circumstances. 

 

  1. Code of Conduct

12.1. Participants are expected to conduct themselves in a respectful and considerate manner towards other participants, staff, and the environment. 

12.2. We reserve the right to withdraw services and remove from a tour any person causing risk to themselves or the environment, negatively impacting others’ enjoyment of their tour, not complying with laws, customs, or drug regulations, or failing to follow reasonable safety instructions from our guides or subcontractors. If this occurs, you agree that you will not be entitled to a refund of any sort and that you will be fully responsible for your travel arrangements from the point of expulsion. 

 

  1. Health and Safety

13.1. Participants are responsible for their own health and well-being during the experience. 

13.2. The Tour Provider will take all reasonable measures to ensure safety but is not liable for any injuries, losses, or damages sustained during the experience. 

 

  1. Risk

14.1. The safety of guests and guides is the Tour Provider’s main priority. As tours operate in the outdoors, they include an inherent element of risk, along with potential exposure to dangers and hazards. Those risks, dangers and hazards include, but are not limited to: slips, falls, varied terrain, changing weather conditions, physical and mental fatigue, acts or omissions of the public or other participants, accident, or illness in remote areas without the possibility of immediate evacuation or availability of medical suppliers or facilities, natural events such as earthquake, avalanche, or landslides, and accidents during travel on the tour, including travel in vehicles operated by the provider or third parties. Encountering these risks, dangers and hazards could result in physical or mental injuries, damage to personal property, or death. You understand that it is impossible for the Trip Facilitator to list in this agreement every possible inherent risk, danger or hazard, but you understand and accept you may encounter these and any other inherent risks, dangers, and hazards not specifically listed in this agreement at any time. 

 

  1. Assumption of risk & liability waiver

15.1 Your voluntary participation in the tour implies your understanding, acceptance and assumption of all the inherent risks, dangers and hazards associated with your participation, whether known or unknown, including those specified. You acknowledge that you are participating with the knowledge of the dangers involved, and that you are voluntarily assuming those risks, dangers and hazards. 

You agree to waive any claim against The Hotel Britomart Limited and Velskov Limited and its owners, directors, employees, and subcontractors, to the fullest extent permissible by law, arising out of personal injury, harm, or any loss whatsoever during your tour, and to bind your successors and representatives by this waiver. You enter this release of liability on behalf of yourself and any members of your travelling party, including those that are under 18, certifying you are the parent or legal guardian of any such minors. 

Considering this: While the providers guides are all thoroughly trained and subject to independently reviewed safety procedures, ultimately, you are responsible for your own health and safety. 

Guides may give important safety and other instructions from time to time. These are required (for example) to ensure the safety of participants, preservation of the environment, and enjoyment of the experience by all. You agree to listen to and follow those instructions and accept that the decision of the providers guides regarding activities and your participation will be final. 

You warrant that you are in good health, with a suitable level of fitness to participate in the tour you are booking. Any medical conditions that may impact your safety, or the safety of other participants on the tour, must be disclosed. You agree that you will not participate in activities if you are feeling unwell while on the tour. 

 

  1. Consent to first aid

16.1. In the unlikely event that you require first aid while on the tour, you consent to your guide or any other person administering first aid to you and any minors travelling with you. You agree to release, indemnify and hold harmless the tour provider Velskov, the facilitator The Hotel Britomart, its directors, employees and subcontractors from any claims for damages that may arise from the provision of first aid. 

 

  1. Environmental Responsibility

17.1. Participants agree to adhere to sustainable practices as led by the guide, including minimising waste, respecting wildlife, and following designated paths. 

17.2. Participants are encouraged to participate in regenerative activities, such as planting trees or contributing to conservation efforts, as part of the experience. 

 

  1. Photography and Media

18.1. The provider reserves the right to take photographs and videos during the experience for promotional purposes. 

The Tour Facilitator and the Tour Provider reserve the right to use any photographic or video images of guests on our tours or any written reviews for promotional purposes. This may include but is not limited to images used online, in printed material or events. You agree that these images, videos and reviews may be used for business purposes without payment or other compensation. 

18.2. Participants who do not wish to be photographed or recorded agree to inform the tour provider in advance. 

 

  1. Data Protection

19.1. The tour facilitator and tour provider will collect and use personal information only as necessary for the operation of the experience and in accordance with applicable data protection laws. 

19.2. Personal information will not be shared with third parties without the participant’s consent, except as required by law. 

 

  1. Complaints

We want your tour to be everything you thought it would be. If you have any issues or complaints during your tour, you agree to raise them at the time with your guides, as almost all matters can be easily sorted out for you on the spot. We will try our best to resolve any issues, and the sooner we know about them the faster and more easily a solution can be found. 

In the unlikely event things can’t be resolved while on your tour, we have a robust complaints procedure and ask that you let us know of your issue within 14 days of the incident, in order to trigger an investigation into the complaint and for us to do our best to find a solution. 

 

  1. Governing Law

21.1. These terms and conditions are governed by the laws of New Zealand. 

21.2. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of New Zealand. 

By booking and participating in this Nourishing Nature regenerative travel experience, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
